TERMS AND CONDITIONS

This Terms of Service Agreement (the "Agreement") is entered into by and between WGY EXPERIENCES INC ("Company," "we," or "us") and the individual or entity accessing our services ("User" or "you"). By accessing or using WGY EXPERIENCES INC's travel planning, concierge, logistics, or consulting services (the "Services"), you agree to be bound by the following Terms.

1. Acceptance of Terms

By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.

2. Description of Services

WGY EXPERIENCES INC is a licensed travel and lifestyle management agency providing, including but not limited to:

  • Luxury travel planning & booking
  • Airline and hotel reservations
  • Ground transportation coordination
  • Restaurant and event reservations
  • Concierge services
  • VIP access coordination
  • B2B logistics, consulting, and production support

The scope of services may expand or vary depending on the client's needs.

3. User Registration

Certain features may require account creation. You agree to provide accurate, complete, and current information and to update it as needed.

4. User Obligations

You agree to:

  • Use the Services for lawful purposes only
  • Maintain the confidentiality of your account login details
  • Not interfere with, disrupt, or attempt to compromise the Services or associated networks

5. Payment and Billing

All fees, retainers, service charges, and professional rates will be invoiced as applicable and must be paid in full before services are rendered or continued.

  • A 3.9% processing fee applies to all credit card transactions
  • A 12% agency service fee applies to all bookings
  • Professional, consulting, and itinerary-development fees are billed according to the "Professional Fees and Retainers" schedule
  • All fees are mandatory, non-refundable, and apply regardless of changes, cancellations, or external circumstances

6. Professional Fees and Retainers

1.) Consulting / Mentor Services

  • $250 per hour, plus applicable taxes
  • A $1,500 consulting fee may apply depending on scope
  • All consulting fees are non-refundable once services begin

2.) Itinerary Development Retainer

  • Minimum 8-hour retainer at $250/hour
  • A $3,500 service fee may apply for complex itineraries
  • Retainers are non-refundable

3.) Logistics / Production / B2B Projects

  • Projects ranging $40,000–$60,000 include a 10–15% service fee
  • A $7,500 USD retainer is required
  • Retainer is non-refundable

7. Intellectual Property

All content, logos, materials, and trademarks are owned by WGY EXPERIENCES INC or its licensors. No reproduction or distribution is permitted without written consent.

8. Force Majeure

We are not responsible for delays, changes, or failures caused by events outside of our control (e.g., weather, pandemics, strikes, political unrest). Refunds are not provided in such cases; credit memos may be issued when applicable.

9. Third-Party Vendor Liability

WGY EXPERIENCES INC acts solely as an intermediary. Third-party policies, penalties, availability, or failures are outside our control. All vendor policies apply in full.

10. Client Responsibilities

You are solely responsible for ensuring compliance with all travel requirements including passports, visas, entry rules, and health protocols.

11. Travel Insurance

We strongly recommend the purchase of comprehensive travel insurance. WGY EXPERIENCES INC is not responsible for losses that could have been insured.

12. Limitation of Liability

Our liability is limited to the fees paid directly to us for our services. We are not liable for indirect, incidental, or consequential damages.

13. Amendments to Bookings

Any changes may incur administrative or supplier fees, which must be paid before the change is processed.

14. No-Show and Late Arrival

Failure to appear for a scheduled service results in forfeiture with no refund or credit.

15. Customer Conduct

WGY EXPERIENCES INC may terminate service for inappropriate, disruptive, or abusive behavior. No refunds will be issued.

16. Currency Fluctuations

Prices quoted in non-USD currencies are subject to exchange-rate adjustments.

17. Chargebacks and Disputes

Unauthorized chargebacks constitute a breach of contract and may result in:

  • Cancellation of services
  • Suspension of ongoing or future bookings
  • Debt recovery and legal action, including fees incurred

18. Jurisdiction & Dispute Resolution

This Agreement is governed by the laws of Florida.

Disputes must first attempt mediation; if unresolved, arbitration will be conducted exclusively in Miami, Florida.

19. Changes to the Terms

WGY EXPERIENCES INC may modify these Terms at any time. Updates will be published on this page.

REFUND / CANCELLATION POLICY

1. Cancellation Notice

Clients must provide cancellation notice at least 72 hours prior to the scheduled service.

2. Cancellation Fees

  • Cancellations within 24 hours of service incur a 100% cancellation fee
  • No-shows incur a 100% fee with no eligibility for rescheduling or credit

3. No Refunds / Credit Memo Policy

WGY EXPERIENCES INC operates under a strict No Refund policy. When applicable, a credit memo may be issued.

Credit memos:

  • Must be used for the same category of service (hotel for hotel, flight for flight, etc.)
  • Are non-transferable
  • Are valid for 12 months
  • Cannot be exchanged for cash
  • Cannot be used directly with third-party vendors

All third-party penalties, fees, or forfeitures are the client's responsibility.

4. Rescheduling

Requests must be made at least 48 hours before the service time. Approval depends on vendor availability and conditions.

5. Chargebacks & Disputes

Attempting to dispute valid charges through a credit card issuer violates these Terms and may result in:

  • Suspension of services
  • Termination of bookings
  • Legal or collection action to recover costs

6. Agreement

By engaging our services, you acknowledge and accept this Refund/Cancellation Policy in full.
